Violência em contexto escolar: school bullying.

Pretende-se analisar o fenómeno social da violência em contexto escolar, em concreto o school bullying, defi-nindo conceitos, examinando as respostas jurídicas existentes para a problemática e a (in)suficiência das mesmas. Relativamente à metodologia utilizada neste artigo, foi realizada uma revisão da literatura já existen-te, fazendo uma pesquisa na base de dados científica (Scielo) com os termos “bullying OR violência na escola OR violências”, no título. Para análise jurídica deste tema, a legislação foi consultada na base de dados (JusNet). A pesquisa efetuada, resultou na identificação de 280 artigos, dos quais foram selecionados 5 para elaboração do presente documento. É necessário reconstruir o conceito de violência escolar e, em concreto, adotar uma definição clara de bullying, distinguindo-o de outros conceitos. Quanto às respostas jurídicas exis-tentes, dificilmente se consegue enquadrar o fenómeno do bullying na legislação existente. É no dever de in-teresse do Estado na Educação, defendido por Durkheim, que nos baseamos para justificar uma possível in-tervenção jurídica no âmbito escolar. Em suma, o legislador precisa de se adequar às novas realidades care-cendo, entre outras, de uma perspectiva sociológica no acto de produção da lei, sendo sensível aos modelos sociais vigentes enquanto base para a produção e alteração das normas legais.

It is intended to analyze the social phenomenon of School violence, defining concepts, examining the existing legal responses and their (in)sufficiency. The methodology used in this article, was review of the existing lite-rature, doing a search in the scien-tific database (Scielo) with the terms “bullying OR violence in school OR violence”, in the title. For legal anal-ysis, the legislation was consulted in the database (JusNet). The research identified 280 articles, of which 5 were selected for this document. It is necessary to remake the concept of school violence, in particular to adopt a clear definition of bullying, distinguishing it from other concepts. Do-esn't seem to us that phenomenon of bullying can be framed in the existing legislation. We justify a possible legal intervention in the school context, based on the duty of interest of the State in Education, defended by Durkheim. In conclusion, the legislator needs to adapt to the new realities, and must be a sociologist from the normative point of view, considering social norms as the basis for supporting legal norms.
